Privacy Officer: privacy@tenacit.com

2. Scope: information we handle for our clients
This policy covers personal information TenacIT collects for its own purposes. It does not cover personal information we process on behalf of our business clients while delivering managed IT, help desk, security, or consulting services, such as data stored in client systems, mailboxes, files, or devices we manage. For that information, TenacIT acts as a “service provider” or “processor,” our client is the “business” or “controller,” and our handling is governed by our agreement with that client.

If you are an employee or customer of one of our clients and have a question or request about your personal information, please contact that organization directly. We will assist our clients in responding to such requests.

Remote support and monitoring. For active clients under a signed service agreement, when you ask us for help or your organization authorizes it, our technicians may connect to your device remotely. During a session they may see what is on your screen, which can include files, email, and other personal information. We limit our access to what is reasonably needed to resolve the request. Please close windows and documents unrelated to your request before a session starts. Where a client has engaged us for security monitoring, we monitor activity on that client’s systems according to the client’s instructions.

Regulated data and client agreements. Where client data includes protected health information, we sign a Business Associate Agreement with the client before handling it, as required by HIPAA. Clients may request our data processing agreement, Standard Contractual Clauses, and current list of subprocessors by emailing privacy@tenacit.com.

Products we resell. Software and services we resell or license to clients, such as Microsoft 365, security software, and password managers, are provided by their vendors and are governed by those vendors’ privacy policies.

TenacIT staff. Personal information about TenacIT’s own employees and contractors is covered by a separate internal notice.

3. Information we collect
We collect the following categories of personal information:

  • Identifiers and contact information: name, business email address, phone number, company name, job title, and mailing address. Sources: you; referrals from clients, partners, and other contacts; and public business sources such as LinkedIn and company websites.
  • Professional information about prospective clients: company, role, and business background, gathered from LinkedIn and other public business sources when we research companies we may work with. Sources: public business sources and referrals.
  • Communications: the content of emails, support tickets, text messages, chat, calls, and video meetings with us. Calls and Microsoft Teams meetings with our team may be recorded, which can capture audio and video, and may be transcribed. We will tell you when a call or meeting is being recorded. Source: you.
  • Support and account information: client portal login details, information about your devices and systems that is needed to resolve a support request, and logs of remote-support sessions. Sources: you and your organization.
  • Commercial and billing information: services purchased, quotes, invoices, and payment records. Card payments are handled by our payment processor; we do not store full payment card numbers. Sources: you and your organization.
  • Internet and device activity: IP address, browser type, operating system, referring website, pages viewed, and date and time of visits, collected through server logs, security tools, and cookies. Source: automatically, when you use the Site.
  • Professional and employment information (applicants): résumé, work history, education, references, and, where permitted by law and with your authorization, background-check results. Sources: you, your references, and background-check providers.
  • Credit information (certain business clients): with your authorization, results of a business credit check. Source: credit reporting agencies.

Sensitive personal information. We do not seek to collect sensitive personal information (such as health information, precise geolocation, racial or ethnic origin, religious beliefs, or government ID numbers) through the Site. Where limited sensitive information is needed for hiring, such as for a background check or employment-eligibility verification, we collect it only with notice and consent where required by law and use it only for that purpose. We do not use sensitive personal information to infer characteristics about you.

4. How we use information
We use personal information to:

  • respond to inquiries and provide quotes;
  • research prospective client companies using public business sources and referrals;
  • deliver, support, and improve our services, including resolving support tickets;
  • send service-related communications, including support text messages you have requested;
  • manage client accounts, billing, and collections;
  • send business marketing communications, which you can opt out of at any time;
  • evaluate job applicants and manage the hiring process;
  • secure our Site, systems, and clients, and detect and prevent fraud or misuse;
  • comply with legal, tax, accounting, and regulatory obligations; and
  • establish, exercise, or defend legal claims.

We do not use personal information for purposes that are materially different from those described here without first giving you notice and, where required, obtaining your consent.
Artificial intelligence and automated tools

We use business versions of AI-enabled tools to help deliver our services, including Microsoft Copilot, Microsoft Teams call transcription, AI features in our ticketing and remote-monitoring platform, and AI assistants such as Claude and ChatGPT. These tools may process the content of support tickets, emails, call recordings, system logs, and documents in order to summarize, transcribe, draft responses, and help troubleshoot.

The providers of these tools act as our service providers. We use their business offerings, with terms and settings that do not permit them to use our data to train their AI models, and our staff may not use personal or consumer AI accounts for TenacIT or client work. We do not use personal information to train our own AI or large language models. Our technicians remain responsible for the work we deliver. We do not use AI or other automated processing to make decisions about you that produce legal or similarly significant effects.

5. Cookies and similar technologies

The Site uses cookies and similar technologies that are necessary for it to function and stay secure. We do not currently use analytics or advertising cookies. Some content on the Site is provided by third parties, such as embedded maps, web fonts, our online scheduling tool (Calendly), and remote-support download links, and those providers may set their own cookies or collect your IP address when that content loads.

You can control or delete cookies through your browser settings. Blocking some cookies may affect how the Site works.

Global Privacy Control (GPC). We treat a GPC signal from your browser as a valid request to opt out of the sale or sharing of personal information and of targeted advertising, for that browser.

Do Not Track. Because there is no common industry standard for “Do Not Track” signals, the Site does not respond to them. We honor GPC as described above.

6. How we disclose information
We disclose personal information only as follows:

  • Service providers that perform services for us under contracts that limit their use of the information, such as cloud hosting, email and collaboration, ticketing and remote-monitoring platforms, remote-support tools, online scheduling (such as Calendly), AI service providers, text-messaging providers, payment processing, accounting, background screening, and IT security.
  • Professional advisors such as attorneys, accountants, auditors, and insurers.
  • Legal and safety purposes: to comply with law, a subpoena, or other legal process; to protect the rights, property, or safety of TenacIT, our clients, or others; or in an emergency.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of all or part of our business. The recipient will be required to honor this policy for the information transferred.
  • With your consent or at your direction.

We do not sell personal information, and we do not “share” personal information for cross-context behavioral (targeted) advertising, as those terms are defined under California and other state privacy laws. We have not done so in the preceding 12 months. We do not knowingly sell or share the personal information of anyone under 18.

Text-messaging information is subject to the additional restrictions in Section 7.

7. Text messaging (SMS)

Texting support (TenacIT Technical Support Messages) is available only to clients with an active managed services agreement. If you text TenacIT’s text support number, we use your mobile number and the content of your messages to respond to your support requests and to send related messages, such as ticket updates, appointment confirmations, and troubleshooting steps. We only reply to texts you send us, and we do not send marketing or promotional text messages. Message frequency varies based on your support requests. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

You can opt out at any time by replying STOP, END, CANCEL, QUIT, UNSUBSCRIBE, REVOKE, or OPT OUT; reply START to resubscribe. Reply HELP for help, or contact support@tenacit.com or call our support line at 1-878-787-7678. You may also opt out by telling us in any reasonable way, such as by email or phone.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of disclosure described in this policy exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

See Section 8 (Text messaging) of our Terms of Use for the full terms of our text-messaging program.

8. How long we keep information
We keep personal information only as long as needed for the purposes described in this policy, unless a longer period is required by law. Typical retention periods are:

  • Website inquiries and prospects: up to 3 years after our last contact.
  • Client account, contract, and billing records: the length of the relationship plus 7 years, for tax and legal purposes.
  • Support tickets and communications: the length of the client relationship plus 3 years.
  • Call and meeting recordings and transcripts: 90 days, unless needed for an open issue or legal hold.
  • Job applicant records: up to 2 years after the hiring decision, or longer where required by law.
  • Background-check and credit reports: up to 2 years after the decision they supported, then securely destroyed.
  • Website and security logs: up to 12 months.
  • SMS opt-out records: as long as needed to honor your request.

When information is no longer needed, we delete or de-identify it. We keep de-identified information in a form that cannot reasonably be linked to you, and we do not attempt to re-identify it.

9. How we protect information
We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information. These include multi-factor authentication, encryption of data in transit, role-based access controls and least-privilege access, endpoint protection and monitoring, and staff training. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you and the appropriate authorities as required by law.

Never send passwords by text or email. Please do not include passwords, payment card numbers, or other sensitive information in support tickets, emails, or text messages. TenacIT will never ask you to send us your password by text message or email. If you receive a message claiming to be from TenacIT that does, do not respond; contact support@tenacit.com or call 1-878-787-7678.
